The latest updates regarding the trial of infringement of the first Graphical User Interface (hereafter as GUI)design application in China has been issued on June 14^th by Beijing Intellectual Property Court on its official weibo account.
    Background of this case: On April 22 ^nd, 2016, Beijing Qihoo 360 Technology co, ltd (hereafter as Qihoo 360) and Qizhi Software co, Ltd (hereafter as Qizhi), the accuser, have sued Beijing Jiangmin Science and Technology Co, Ltd, the accused, for using the accuser’s developed GUI on his own user interface, which has infringed three below design application owned by Qihoo 360 and Qizhi, ZL201430324280.2, ZL201430329167.3, ZL201430324283.6. Qihoo 360 and Qizhi has requested the Court to ask the accused stopping infringing the above design patent and a compensation of CNY 15 million for all the financial losses, court costs, etc.
    Latest updates: Recently, Jiangmin, the accused, has requested the patent reexamination board for an announcement of invalidation regarding above case, based on the request Jiangmin has also asked the Beijing Intellectual Property Court to suspend a hearing. After investigation the collegiate bench has announced that case is still alive and rejected Jiangmin’s previous request because Qihoo 360 has already submitted the evaluation report of the three design application, which shows the stability of the design patent. 
    Background of GUI Patent: GUI is referring to the user’s interface attached on the display screen, which appears as visual images connecting the operation system. Users could touch the icons on the screen to operate. In 2014, the revised Patent Review Guidelines issued by the State Intellectual Property Office of P. R. China has specified the GUI design application as protected intellectual property rights. The GUI design application submitted by Qihoo 360 on August 14^th, 2014 was the first granted design application in China, which shows the development of GUI patent protection.
